One more penalty for a photo with birds and cells: 25 basic units Levinau Paul (video)

On December 17, Zheleznodorozhny District Court of Vitebsk finished the last trial of the participants in a photo shoot "with cells and birds." The trial of Paul Levinau led Judge Elena Tsygankova. In her decision, Paul Levinau must pay a fine of 25 basic units - 3.75 million rubles.

Witnesses at this trial, as in the previous proceedings incident photoshoot, was not. Paul testified against Levinau employee of the Railway Department of Internal Affairs, Major Alexander Rybak, who was participating in the photo shoot protocols offenses for unauthorized picketing. According to him, all the participants of the photo shoot, which were photographed on a background of graffiti with the same cells and paper origami birds from newspapers to pursue the idea of an unknown artist - without permission from the authorities expressed their "personal and public interests."

Major police did not hide the fact that the case against seven residents of Vitebsk were initiated on the initiative of the chief of department of law enforcement and prevention of the regional police management Alexander Kalinowski. He gave the order to train the police department to "deal" with journalists and activists who were photographed in a public place. Because then these photos hit the internet, and that was the main feature for the police and the proof of the offense.

Judge Elena Tsygankova not satisfy any application to human rights, including the adjournment of the meeting at a later time, as he came to court ill. And what about the petitions stated that their "too much", and Paul made two comments Levinau - for what he allegedly deliberately delaying the process.

Mrs. Tsygankova such a hurry that is not allowed to make a two-minute break even - to Levinau Paul raised his complaint to the chairman of the court in the next room. The complaint concerned the behavior of the judge Elena Tsygankova, which categorically rejects the application and satisfies the objections of his candidacy.

The only request, the judge satisfied the first day of the court on 12 December, had permission to film the process. However, Elena Tsygankova banned shoot present in the court room, allowing it only to the defendant. Therefore Levinau had to bring motions and to testify, holding a video camera.

One of the applications of human rights defender was about to attach photos to the case of the Internet, where Paul himself Levinau conduct individual picket. It happened last year, also in November, but the police into account why not horrible. According to Paul Levinau, a keen interest in it to the photo shoot journalists and activists - is obvious. But as it is called - remains unknown.

Major Alexander Rybak was only repeating what has been said in the previous processes: it was not a photo shoot, and unauthorized picketing.

Zheleznodorozhny District Court supported this position: Judge Denis Gubanov and Elena Tsygankova recognized all participants photoshoot offenders. In addition to Paul Levinau for allegedly participating in an unsanctioned fines received journalists Dmitry Kazakevitch, Elena Stepanova, Kastus Mardzvincau (20 basic units each), coordinator of the organizing committee of the BCD Tatiana Sevyarynets (25 basic units) and an activist of the same organizing committee Elena Shabunya (18 basic units). Casual passer-by Peter Berlinov, who joined the photo shoot, was sentenced to three days in jail.
