Chairman of the Free Trade Union of the primary “Polotsk-Fiberglass” complains Vitebsk regional court (video)

Chairman of the primary organization of the SPB "Fiberglass" Victor Stukau filed a complaint with the regional court to determine the Polotsk City Court, which on August 18 refused to hear the case of discrimination based on membership in one or another union.

Recall union primary cell JSC «Polotsk-Fiberglass" has long been fighting against the discriminatory provisions in the collective agreement. According to members of the Free Trade Union, such a discriminatory provision is the point of the collective agreement, according to which, in order to dismiss a member of the pro-government enterprise "Belkhimprofsoyuz", requires the consent of the union, and for the dismissal of a member of the Free Trade Union of no consent is not required - just tell the union of the decision-making the dismissal of an employee.

Courts - from the city and up to the Supreme and Constitutional - repeatedly refused to recognize the fact of discrimination. August 18 in the Polotsk City Court consideration of the next chairman of the union of the primary claim against JSC "Polotsk-Fiberglass" - on newly discovered evidence: more than a year ago Polotsk Court refused to consider a substantially similar case and recommend Stukov to eliminate discrimination apply to "Belkhimprofsoyuz".

Recommendation trial was performed, but without positive results. Meanwhile, from August 1 this year introduced a new collective bargaining agreement, in which discriminatory item remained in place. These circumstances gave rise to go back to court "on newly discovered evidence." However, the Court of Polotsk remained at their previous positions and determined: "Deny to Stukau Viktor Yakovlevich to revise the newly discovered circumstances of the court Polotsk Polotsk district and 19 March 2013".

"Although the Labour Code specifically authorizes the employee to go to court, if it considers that this constitutes discrimination, however more than one and a half years of Polotsk Court and the courts, which we passed, refuse to consider the fact of discrimination on the JSC Polotsk-Fiberglass" - complains Victor Stukau.
