Investigative Committee: The actions of activists not constitute a crime

Acting Chief of enforcement and prevention of the Department of the Interior and police administration district of Vitebsk Railway Police Major K. Odnopalov refused to open a criminal case under Art. 391 (insulting a judge or a lay judge in the exercise of justice) in respect of a civil activist Nadyezhda Kukanos.

The reason for refusal - in action Nadyezhda not constitute a crime. If a criminal case was opened yet, activist faced fines of up to 1000 base values or restriction of freedom for up to three years.

In August of this year to the Chairman of the Vitebsk regional court Nadyezhda Kukanos complaint was filed by a judge's Railway district court of Vitebsk Helena Tsygankova and chairman of the same court Raisa Lupenkova. In the complaint, according to the judge and president of the court, Kukanos made offensive remarks.

In a survey of activist acknowledged the complaint filed against the judge and the president of the court, but categorically denied that his remarks had intended to insult the servants of Themis. In her complaint, Ms. Kukanos hast really harsh criticism and gave a negative assessment of the professionalism and the judges and the president of the court Tsygankova Lupenkovoy, however, according to activists, critical words were expressed in decent shape, no coarse and offensive language.

The city department of the Investigative Committee of Vitebsk in resolving the issue of a criminal case under Art. 391 of the Criminal Code, did not find the materials inspection is sufficient evidence pointing to signs of a crime - an insult to the judges. According to employees of State Committee, a critical assessment of competency of judges Tsygankova and Lupenkova that Kukanos given in the complaint, it is a subjective opinion and not an insult.

After such a conclusion investigators audit materials through the prosecutor's office in Vitebsk were returned to the Department of the Interior and police major Odnopalovu nothing to do but to abandon the prosecution of Nadyezhda Kukanos.
